The occasional lease and the winter protection period: is eviction possible?

For standard leases, Polish law introduces a protection period that restricts evictions during certain months of the year — so a landlord may be unable to recover the flat in winter even from a tenant who has stopped paying. With an occasional lease the situation is different.

Conditions without which the special regime does not apply:

  • the complete set of mandatory annexes to the lease
  • the tenant's declaration drawn up before a notary
  • designation of the fallback property and its owner's consent
  • notification to the tax office within 14 days of the lease starting

The occasional lease gives a landlord markedly more protection, but only when every formality is completed correctly and on time. One missed filing turns it back into an ordinary lease.
