What is najem okazjonalny and how it differs from a standard lease

Najem okazjonalny is a special type of residential lease defined in Poland's tenant protection law. It was created to give landlords extra security while giving tenants clear, transparent living conditions.
The main difference from a standard lease
Under a standard lease, removing a non-paying tenant requires a court case that can take months. Najem okazjonalny assumes from the outset a notarised statement by the tenant agreeing to vacate, plus a designated replacement property — which allows the owner to recover the flat far faster if the lease is breached.
What the tenant gains
Despite its reputation as a landlord-friendly contract, najem okazjonalny fixes the term, the rent and the rules for its indexation, as well as the conditions for returning the deposit — which protects the tenant from arbitrary changes during the lease.
An occasional lease agreement must include:
- a written agreement for a fixed term of no more than ten years
- the tenant's notarised submission to enforcement
- designation of a replacement property and its owner's declaration of consent
- notification to the tax office within fourteen days of the lease starting
The agreement must be reported to the tax office competent for the landlord's place of residence within 14 days of the lease starting — without that, the simplified eviction route does not apply.
